While nothing has been filed yet the owners of the LA Dodgers have unhappy differences and have lawyered up to take sides against one another. Seems like people in the know about the McCourts say there is not enough cash around for only one of them to wind up with the team. So.......what's your take on how Frank's team will try and play this? The company appears to be a Delaware based LLC.......and the timing of the family move seems to coincide with the purchase of the team. Do you suspect they will attempt to make the argument that it is not community property because they were either not yet residents of California at the time of the acquisition.....or not residents long enough to have established their domiciliary?

If the parties established California as their residence any property acquired by them during marriage and before becoming a resident is treated as "quasi" community property entitling each to half of its value.
Perhaps the first legal round will be over who files where and which court has jurisdiction.

And now a high priced powerful executive would like the court to believe that she was not represented by counsel before signing a 2004 property settlement agreement....effectively acknowledging the Dodgers as the separate property of her husband.

In transactions between spouses there is a presumption of undue influence if one spouse gains an advantage over the other by the transaction. If the writing exists we start from the standpoint that Frank exerted undue influence and the transfer is not valid... it is up to Frank to rebut that presumption.
