Is there a form mom can sign to immediatly stop child support?

Facts:

Dad pays mom child support for two children. The court order states $325.00 per child.

Mom & Dad have been going through a bitter custody dispute. Mom recently refused to agree to the mediator's 50/50 recommendation. Now they are scheduled for Trial in January.

Mom sent dad an email on Monday stating she has given their 16 year old son a choice and he chose to live full time with dad and see mom when he chooses to.

Mom wants the court order to stay the same until court. It's currently 60/40 with mom having 60.

Dad wants to have her sign a notorized letter stating she agrees to let son live with dad. The court order states they can change the order as long as it's in writing & notorized.

Dad has not discussed this issue or the issue of child support with mom. Before he does, he wants to get his homework done.

Court is 2 months behind right now. If he files, it won't be heard until January and he already has a hearing set for that month.

Is there anything that he can to do expedite the child support issue. That money should go with the child.

The first thing to do is a support calculation based on the current incomes and the new custodial arrangement. If the current support is to be less file an OSC for modification. If an agreement is reached you can use a stipulation and order form.

Guess it doesn't matter now. Mom got mad at dad and took the 16 year old back. The damage is already done though. The boy is so upset with her and there is a string of emails proving her tug-o-war attitude.
